A Quick Refresher: Measure 109 and Legal Psilocybin Therapy

In 2020, voters in Oregon approved Measure 109, which initiated the Oregon Psilocybin Services Act. This law created a legal and regulated framework for the therapeutic use of psilocybin in licensed establishments. The Oregon Health Authority (OHA) set strict frameworks for these establishments. 

The OHA began accepting licensure applications in January 2023, and licensed service centers opened shortly after. Bend Inner Alchemy is proud to be an Oregon state licensed service center.

Understanding the Confusion: Measure 110 vs. Measure 109

Much of the current uncertainty about the legal circumstances regarding psilocybin stems from recent discussions surrounding Measure 110. This is a law that decriminalized the personal possession of specific substances, such as psilocybin.

In other words: 

• Measure 109 (Still Active):
  Legalized licensed psilocybin therapy in supervised, professional settings. This is the framework under which Bend Inner Alchemy operates.
  
  
• Measure 110 (Now Under Review):
  Decriminalized personal possession of small amounts of controlled substances (including psilocybin, heroin, and methamphetamine). This law is now being reconsidered by lawmakers, especially in response to the fentanyl crisis.
  
  

Even if aspects of Measure 110 are rolled back, these changes do not affect Measure 109. That means licensed psilocybin therapy in Oregon remains legal, protected, and fully operational. 

What About Local Bans?

Some cities and counties in Oregon have voted to ban psilocybin services within their local jurisdictions. These decisions are local and not statewide.

Bend is not affected by these local bans. Bend Inner Alchemy is located in a region that welcomes and regulates psilocybin therapy under the OHA’s guidance.

Do You Need to Be an Oregon Resident?

No. Psilocybin therapy in Oregon is available to anyone over the age of 21, regardless of where you live. There is no residency requirement. Whether you are a resident or visiting from another state, you can legally participate in a guided psilocybin experience at our certified facility.

Licensed Therapy Is Still Protected and Growing

The landscape of licensed psilocybin therapy continues to flourish and grow. As of late 2024, there are:

• 31 licensed psilocybin service centers actively operating across Oregon
  
  
• More than 8,000 clients who have already participated in legal, guided psilocybin therapy sessions
  
  
• Ongoing training, licensing, and oversight managed by the Oregon Health Authority
